Welcome to Eterna Flowers Jewels! The terms “we,” “us,” and “our” refer to Eterna Flowers Jewels, based in Stuttgart, Germany. These Terms of Service (“Terms”) govern your use of our website, online store, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

The Services are hosted by domainfactory, which provides technical hosting only. All purchases and transactions are conducted directly with Eterna Flowers Jewels. Domainfactory is not responsible for products, orders, payments, or customer service.

These Terms apply to all orders placed through our online store. If you are a consumer (i.e., an individual acting for purposes which are wholly or mainly outside your trade, business, craft, or profession), statutory warranty rights under German law remain unaffected and are in no way limited by these Terms.

1. Access and Account

You must be at least the legal age of majority in your country to use the Services. (You must be at least 16 years old to create an account, or the applicable age of digital consent in your country, whichever is higher)
Account information must be accurate and complete.
You are responsible for account security and all activity under your account. Do not share login credentials.

2. Products

We strive to accurately display products, but colors and appearance may vary depending on your device.
Product descriptions may change without notice.
We may limit quantities or discontinue products at any time.
All product dimensions and weights are approximate.

3. Orders

Placing an order is an offer to purchase. Orders are only accepted once confirmed by Eterna Flowers Jewels.
Review orders carefully before submission; cancellation after acceptance may not be possible.
All purchases are subject to our Refund Policy.
The presentation of products on our website constitutes a non-binding invitation to you to make an offer (an 'order'). A binding purchase contract is only formed when we expressly accept your order by sending a separate order confirmation email ('Auftragsbestätigung'). We reserve the right to refuse any order before acceptance, e.g., in case of stock shortages, pricing errors, or suspicion of fraud.

4. Prices and Billing

Prices include German VAT where applicable. International customers may be subject to customs duties or import taxes.
Prices, discounts, and promotions may change without notice.
You must provide accurate billing, shipping, and payment information and promptly update changes.
International Customers (outside Germany/EU): All prices are exclusive of any customs duties, import taxes, brokerage fees, or similar charges that may be levied by the destination country. You, as the customer, are solely responsible for paying all such fees and taxes. Please contact your local customs office for information on applicable regulations and rates.

5. Shipping and Delivery

Shipping times are estimates only; delays due to carriers, customs, or external events are not our responsibility.
Risk of loss passes to you upon transfer to the carrier.
Unless otherwise stated, we aim to ship orders within 3-5 business days after order confirmation. Delivery times by the carrier are estimates only.

6. Intellectual Property

All content on the Services (text, images, logos, designs, videos, etc.) is owned by Eterna Flowers Jewels or its licensors and is protected under German and international copyright, trademark, and intellectual property law.
You may only use content for personal, non-commercial purposes. Unauthorized use is prohibited.
Trademarks, logos, and product names may not be used without prior written consent.

7. Optional Tools and Third-Party Services

By submitting feedback, you grant Eterna Flowers Jewels a worldwide, royalty-free, sublicensable license to use, modify, and distribute your feedback.

13. Termination

Sections regarding Intellectual Property, Feedback, Liability, Governing Law, and Privacy survive termination.

14. Governing Law and Jurisdiction

These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, to the exclusion of its conflict of law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers residing in the European Union: Notwithstanding the foregoing, if you are a consumer with your habitual residence in another EU member state, mandatory consumer protection provisions of that country may apply, and you may bring legal proceedings in the courts of your country of residence.
Place of Jurisdiction: For any disputes with merchants, legal entities under public law, or consumers who do not have a general place of jurisdiction in Germany or who have moved their domicile or habitual residence outside Germany after conclusion of the contract, or whose domicile or habitual residence is not known at the time the action is filed, the place of jurisdiction shall be Ludwigsburg, Germany.

We may update these Terms at any time.
Material changes will be communicated, and continued use constitutes acceptance.

16. Privacy

17. Refunds, Returns, and Shipping

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the use of the Services and purchase of products, superseding any prior agreements.
